These terms govern your use of the Inkbox platform. By signing up or using our services, you agree to be bound by these terms, in accordance with Guinean law.

Acceptance of terms

By accessing Inkbox and using our services, you agree to be bound by these Terms of Use. If you do not accept these terms, please do not use the service. These terms constitute a legally binding agreement between you and Inkbox, in accordance with the legislation in force in the Republic of Guinea.

Description of services

Inkbox provides a professional email hosting and management platform including:

Email infrastructure

SMTP, IMAP, webmail and integrated anti-spam

Multi-domain

Automatic configuration of DNS records (MX, SPF, DKIM, DMARC)

Mailbox management

Creation, suspension and aliases of mailboxes

Administration console

Management of organizations, roles and permissions

Eligibility

Use of the service is reserved for adults capable of contracting within the meaning of the Guinean Civil and Criminal Code, or legal entities represented by an authorized adult. Registration of a minor must be carried out under the responsibility of a legal representative.

User accounts

As the holder of an account, you are solely responsible for:

    Providing accurate, complete and up-to-date information during registration

    Maintaining the confidentiality of your credentials and passwords

    Restricting access to your devices and accounts
  • 4
    All activities occurring under your account, authorized or not

Notify us immediately of any unauthorized access to your account or any suspicion of compromise.

Acceptable use

Use of the service must comply with Guinean law and the international commitments of the Republic of Guinea. The following are strictly prohibited:

Unauthorized access or fraudulent maintenance in an information system (Art. 4-6)
Obstruction, falsification or fraudulent introduction of data (Art. 7-9)
Interception, modification or unauthorized deletion of communications (Art. 10-13, 55)
Sending spam, direct prospecting without consent or unsolicited electronic messages (Art. 47-50)
Distribution of racist, xenophobic, child pornography or content infringing human dignity (Art. 21-30)
Threats, insults, false information or incitement to violence (Art. 28-36)
Computer fraud, scams, information theft or money laundering (Art. 14-20, 39-41)
Identity theft or use of false identification data (Art. 45, 46, 51)
Infringement of intellectual property (Art. 58)

Content and liability

Inkbox acts as a technical hosting provider. In accordance with Guinean law (Art. 72, 82 and 83), our civil and criminal liability cannot be engaged for content transmitted or stored by users, provided that we are not the author, selector or modifier of such content.

In the event of notification of unlawful content in accordance with Articles 72 and 73 of Guinean law, we act promptly to remove such content or make access impossible.

The user is solely responsible for the content they send, receive, store or transmit through the service. They agree to indemnify Inkbox against any damage resulting from unlawful or non-compliant use of the service.

Data protection

The processing of personal data is governed by our Privacy Policy and complies with Guinean data protection law. The user agrees to:

Only collect and process personal data in compliance with the principles of lawfulness, fairness and proportionality
Obtain prior consent from data subjects where required by law
Inform data subjects of their rights
Implement appropriate security measures

Plans and billing

Subscriptions are billed monthly or annually according to the subscribed plan.

After renewal

Payments are processed via Stripe. Inkbox does not store bank card data. Any fraudulent use of the service in connection with payment constitutes a criminal offense.

Security obligations

The user agrees to:

Not attempt to circumvent the security measures of the service
Not introduce viruses, malware or any harmful program
Not carry out computer attacks against the platform or other users
Immediately report any vulnerability or security incident
Use strong authentication when it is offered

Suspension and termination

Inkbox reserves the right to suspend or terminate an account, without notice, in the event of:

Violation of these terms of use
Unlawful use of the service or commission of criminal offenses
Non-payment of subscription fees
Motivated request from the competent authorities

The user may terminate their subscription at any time from their client space. Data is retained for 30 days after termination, unless an express request for immediate deletion or a legal obligation to retain applies.

Limitation of liability

To the fullest extent permitted by applicable law, Inkbox shall not be liable for:

Indirect, incidental or consequential damages
Any loss of profits or revenues, direct or indirect
Service interruptions due to force majeure or causes beyond our reasonable control
The content of communications sent or received by users

Modifications

We reserve the right to modify these terms at any time. Modifications take effect immediately upon publication. For substantial changes, we will notify you by email with 15 days' notice. Your continued use of the service constitutes your acceptance of the new terms.

Governing law

These terms are governed by the legislation in force in the Republic of Guinea, in particular:

The law relating to cybersecurity and the protection of personal data
The law relating to telecommunications and information technologies
The Guinean Criminal Code
The Guinean Code of Criminal Procedure

Any dispute shall fall under the jurisdiction of the competent Guinean courts.
